1. Scope of Application, Provider, Choice of Law and Jurisdiction

1. These General Terms and Conditions (GTC) govern all offers and services provided by the Provider, in particular individual, couple, and group coaching sessions, as well as digital content. The Provider is Robert Herrmann, Sebastian-Bach-Str. 47, 04109 Leipzig, Germany; USt-IdNr.: DE355643174.
2. German law shall apply; mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.
3. Place of jurisdiction:
   a) No differing agreement on the place of jurisdiction shall be made with respect to consumers; the statutory rules on jurisdiction shall apply.
   b) In relation to entrepreneurs/merchants, the place of jurisdiction shall be - to the extent legally permissible – the registered office of the the Provider in accordance with Section 38 of the German Code of Civil Procedure (§ 38 ZPO).

2. Conclusion of Contract, Incorporation of GTC, Communication

1. Bookings may be made via the website/affiliated platforms, by email, or by telephone; acceptance shall occur via confirmation email or by the provision of/access to the booked services.
2. The GTC shall be provided prior to the conclusion of the contract and shall be incorporated upon the conclusion of the contract.
3. Orally agreed follow-up appointments are binding; for evidentiary purposes, they shall be confirmed in text form.
4. Contract-relevant information (in particular dates/appointments, cancellations, and right of withdrawal) shall be confirmed to the customer on a durable medium.

3. Services and Procedures

1. The Provider provides coaching services in individual, couple, and group formats and offers digital content (audio/video/PDF/platform).
2. No medical healing services are provided; no diagnoses are made, and no promises of cure are given; coaching shall not be a substitute for medical or psychotherapeutic treatment.
3. Terms used in public communications such as “couples therapy” are used for descriptive purposes only; legally, these services constitute coaching services and do not involve the practice of medicine or the healing arts.
4. No specific outcome or success is guaranteed; coaching promotes self-responsibility and personal development.
5. Sessions may take place online, on-site, or in a hybrid format; the respective duration and format shall be specified at the time of booking.
6. Digital Content: Customers shall be granted access to the course content for a period of 12 months from the date of purchase; the course content is provided exclusively for self-directed study; there is expressly no individual monitoring of learning progress, and no evaluation of learning outcomes by the Provider.

4. Participation Requirements, Professional Responsibility

1. Participation requires sufficient mental stability; participation is excluded in cases of acute mental crises, suicidal tendencies, or conditions requiring medical treatment.
2. The Provider may terminate the cooperation or exclude the Client from further participation if this is not professionally justifiable; fees already paid shall be refunded pro rata for services not rendered, taking into account saved expenses and alternative use of resources.

5. Prices, Payment, Late Payment

1. The respective displayed total prices shall apply, including value added tax (VAT).
2. Payment: For individual and couple coaching sessions conducted online, payment is due prior to the appointment; for on-site appointments, payment is due immediately upon completion of the session. Programs shall be paid for in full before the start date.
3. In the event of late payment, default interest at the statutory rate shall apply (§ 288 BGB). Reasonable dunning fees per level (e.g. 5 EUR) may be charged; the Client remains expressly permitted to prove that no damage or only minor damage has occurred; personnel costs shall not be included as flat-rate charges. In the event of continued default in payment, access to the services may be temporarily suspended following prior written notice and shall be reactivated only upon full payment.

6. Rescheduling, Cancellation and No-Show Policy

1. Rescheduling is possible free of charge up to 48 hours before the scheduled appointment.
2. In the event of cancellation, rescheduling or failure to attend (no-show) less than 48 hours before the scheduled appointment, a flat-rate cancellation fee in the amount of 100 % of the agreed fee shall apply; the Client expressly reserves the right to prove that no damage or a lower damage has occurred. Substitute participants or make-up appointments shall not be offered in this context.

7. Program Duration, Expiry, Flexibilit

1. For package bookings, the included sessions must be completed within 6 months of the date of purchase or the commencement of the contract.
2. Unused sessions shall expire after 6 months, unless the non-utilization is due to reasons within the Provider’s sphere of responsibility, or a proven case of hardship; in such cases, a reasonable extension shall be granted as a priority, the duration of which shall depend on the individual case. Only if an extension is unreasonable or impossible shall a pro rata refund be issued, taking into account saved expenses.
3. In the event that a couple decides to separate, any remaining couple sessions may be converted into 1:1 sessions; a conversion of 1:1 sessions into couple sessions is excluded.

8. Right of Withdrawal (Consumers)

1. Consumers are entitled to a right of withdrawal within 14 days of the conclusion of the contract.
2. Digital Content with Immediate Access: The right of withdrawal expires if the Customer expressly consents to the performance beginning before the end of the withdrawal period and acknowledges that they thereby lose their right of withdrawal; the confirmation shall be provided on a durable medium.
3. Services: The right of withdrawal shall expire upon full performance of the service, provided that the service has begun with the Custome’s prior express consent and acknowledgement that the right of withdrawal is lost upon full performance; in the event of withdrawal after the commencement of performance, a reasonable pro rata compensation shall be paid for the services provided to that point.
4. The withdrawal may be declared via email, by using the model withdrawal form, or through the electronic withdrawal function (withdrawal button) on the website; if the withdrawal button is used, the confirmation of receipt shall be provided immediately on a durable medium.

9. Liability and Responsibility

1. Participation is at the Client’s own risk; the Provider shall provide its services with due care.
2. The Provider’s liability for intent and gross negligence is unlimited; in cases of simple negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations), and such liability shall be limited to the typical foreseeable damage; claims for injury to life, body, and health remain unaffected.
3. No liability is assumed for disruptions outside the Provider’s control (e.g. outages of third-party platforms); in the event of such disruptions, reasonable alternative services shall be provided.
4. No liability is assumed for the conduct of other participants; the Code of Conduct must be observed.
5. Confidentiality shall be maintained; statutory obligations remain unaffected.

10. Group Settings: Code of Conduct and Confidentiality

1. All participants commit to mutual confidentiality; No content shall be disclosed without the consent of the parties concerned.
2. Communication must remain respectful and appreciative at all times; any form of recording is prohibited. Violations may lead to exclusion from the program; in such cases, a pro rata refund will only be issued for services not yet rendered.

11. Copyright and Usage Rights

1. All content is protected by copyright. A simple, non-transferable right of use is granted for personal use only; any reproduction, distribution, or making available to the public without prior written consent is expressly prohibited.
2. Couples are permitted to jointly use digital content explicitly designated for couples; any further disclosure or distribution remains prohibited.
3. No audio, image, or video recordings are permitted without prior written consent; this applies to live and online sessions as well as digital content.

12. Data Protection

1. Personal data are processed for the purpose of contract fulfillment and communication; where applicable, separate consent shall be obtained for further information.
2. Carefully selected third-party providers are employed; for data transfers to third countries, appropriate safeguards (e.g. Standard Contractual Clauses – SCC) are implemented.
3. Data subjects have the right of access, rectification, erasure, restriction of processing, data portability, as well as the right to withdraw any consent given.
4. The Provider’s Privacy Policy shall apply additionally.

13. Minimum Number of Participants; Cancellation by the Provider

1. Group formats may require a minimum number of participants. If this number is not reached by a specific date, the Provider may cancel the service; any fees already paid shall be refunded or credited toward a rescheduled date. 
2. In the event of force majeure or government orders, alternative appointments or vouchers shall be offered or a pro-rata refund shall be issued.

14. Force Majeure

In the event of force majeure (including official orders, pandemics, widespread infrastructure failures), appointments will be rescheduled or provided in a reasonable manner through equivalent digital or alternative formats; if this is impossible, a pro rata refund will be issued, taking into account saved expenses.

15. Technical Platforms and Alternative Formats

The Provider carefully selects market-standard platforms and implements appropriate technical and organizational measures. In the event of disruption or outages, reasonable alternative services will be offered (e.g. make-up dates, recordings, alternative tools); No guarantee is provided for the stability of third-party platforms.

16. Photo, Audio and Video Regulations

No recordings or captures are permitted without the prior consent of all parties involved; the protection of personality rights shall take precedence. Photo, audio, and video recordings are prohibited unless express written consent has been granted.

17. Final Provisions; Dispute Resolution

1. Amendments and supplements to these GTC shall require text form.
2. Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
3. The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board; the reference to the ODR platform is provided for informational purposes only.

Clarifying Notes on Terminology

Distinction between coaching and therapy: Regardless of any terminology used in public communications (e.g. “couples therapy”), the services provided constitute coaching services and do not involve the practice of medicine or the healing arts; No diagnoses, medical treatments, or promises of cure shall be provided.
